Interesting article on legislation that would give property owners more protection in Iowa from the use of eminent domain.

There has been much resistance to the R-Project since the very beginning, as it seems to best serve the interests of the Southwest Power Pool, and not Nebraskans. Nebraska Public Power District has bragged in recent weeks of their track record of 98% voluntary agreements signed for easements on past projects. Many landowner’s all along the route of the R-project refuse to even sign a right-of-entry agreement to let NPPD begin preliminary work on their property. Acheiving 98% of voluntary agreements on this controversial project is simply unrealistic.

What do you think? Should there be a plateau of voluntary agreements public entities, like NPPD, should have to reach before exercising the use of eminent domain? Or should they always automatically have the right to use eminent domain?
